The algorithm of the investor's actions to ensure access to the facilities has been approved
The Ministry of Economic Development and the Ministry of Transport of Russia have published an approximate action plan for the investor in the event that there is a need to provide access to the facility for road transport. This includes the construction and reconstruction of intersections and junctions to highways.
The corresponding order was issued on March 15, 2023. The subjects of the Russian Federation will rely on it when developing a set of investment rules.
The algorithm of access to the investor's objects implies clear deadlines and procedures.
The first step is for the investor to obtain the prior consent of the owner of the highway, if it is privately owned. With regard to federal roads, the investor provides an application and a scheme of the planned connection to the highway, guided by federal legislation (Article 20 No. 257-FZ, as well as the order of the Ministry of Transport of the Russian Federation No. 261 of July 9, 2018). In relation to regional or intermunicipal roads - according to the list of regulations of the subjects of the Russian Federation. As a result, no more than 30 days after the application, the investor must receive a written permission with technical requirements.
Then the investor provides project assignments for documentation on the layout of the territory and for the performance of engineering surveys (or a certificate-justification that they are not necessary). For federal roads, this is the procedure approved by the Ministry of Transport of the Russian Federation No. 573 of December 25, 2020, for regional, inter–municipal and local roads - the legislation of the subject. The decision on the preparation of documentation must be received within 15 days, and the decision on approval will take at least 20 days. If necessary, a public discussion or public hearings on the planning of the territory are held.
It will also take 20 days for the registration of title documents. For investment projects, this is a public easement (with the exception of road service facilities). The terms of development of documentation for the construction of an abutment to the highway are determined by the contract with the project organization. The algorithm published by the Ministry of Economic Development and the Ministry of Transport of Russia sets no more than 5 days for obtaining a construction permit, and if all the documents required by law are available, a permit for commissioning will be issued in 5 days.
